Legal Support Timeline

Pregnancy and parenthood are protected by a complex web of federal and state laws. While these protections are powerful, navigating them to ensure you receive everything you're entitled to often requires legal assistance.

Laws Protecting You Include, But Are Not Limited To:

  • Pregnant Workers Fairness Act (Federal)
  • Family & Medical Leave Act (Federal)
  • Americans with Disabilities Act (Federal)
  • Title VII Civil Rights Act (Federal)
  • NY Paid Prenatal Leave Law
  • NY Paid Family Leave

Each law has different requirements, timelines, and remedies. Employers know this complexity can be overwhelming — don't let that stop you from claiming what's rightfully yours.

Phase 1

Pre-Natal Care

Before pregnancy and during early planning, protect your rights to fertility treatments, prenatal appointments, and pregnancy-related healthcare.

🗽 New York's Historic Prenatal Leave Law

As of January 1, 2025, New York became the first state in the nation to provide 20 hours of paid prenatal leave per year for all pregnant employees, regardless of company size or how long they've worked for their employer.

Covered Prenatal Services:

  • Physical examinations and medical consultations with healthcare providers
  • Fertility treatments including in vitro fertilization (IVF)
  • Egg freezing and fertility preservation procedures
  • Medical procedures, monitoring, and testing related to pregnancy
  • Prenatal genetic testing and screenings
  • Specialty consultations (high-risk pregnancy, maternal-fetal medicine)
  • Ultrasounds and routine prenatal checkups

Important: This leave is available in hourly increments and is paid at your regular rate of pay. Your employer cannot ask for confidential medical details or require you to use other leave types first.

Phase 2

Pregnancy Accommodations

Once pregnant, you have federal and state rights to reasonable workplace accommodations throughout your pregnancy. The Pregnant Workers Fairness Act ensures employers must provide modifications that allow you to continue working safely.

🌅 First Trimester

Common accommodations during early pregnancy when symptoms like morning sickness and fatigue are most prevalent:

  • Flexible scheduling for severe morning sickness
  • Modified work hours to accommodate nausea patterns
  • Permission to eat small snacks throughout the day
  • Time off for frequent prenatal appointments
  • Temporary reassignment away from hazardous substances
  • Closer parking or modified commute arrangements
  • Permission to keep crackers or ginger at workstation

☀️ Second Trimester

As your pregnancy progresses, different accommodations may become necessary:

  • Ergonomic seating and workstation adjustments
  • Modified lifting restrictions (typically 20-25 lbs or less)
  • More frequent breaks to prevent prolonged standing
  • Assistance with physically demanding tasks
  • Modified travel requirements
  • Adjustment of workload during energy fluctuations
  • Permission to prop feet up while working

🌙 Third Trimester

During the final months, accommodations focus on comfort and safety as mobility becomes more challenging:

  • More frequent bathroom breaks (every 1-2 hours)
  • Permission to keep a water bottle at all times
  • Comfortable seating options or ability to sit frequently
  • Reduced standing time or standing breaks
  • Modified work schedule to accommodate doctor appointments
  • Assistance with bending, reaching, or lifting
  • Flexible arrival times for comfort and safety
  • Permission to leave early if experiencing discomfort
